Terms Of Use - Digital Works
For Auction Sites
Unless noted in the listing, I
do not allow you to host your own
images, as this is part of your
single user license. As you are
purchasing at discounted prices,
I have to protect my intellectual
property and I appreciate your understanding
of this matter. Please be aware
that I will follow this up and that
feedback will be received accordingly.
As a member of eBay's VeRO program,
you will also be reported to eBay
and you risk becoming no longer
a registered user (NARU).
All my designs will have reference
to me 'ideaswoman.com' as the designer
within the design. If you are not
happy to have this, then please
do not order. The light bulb watermark
will be removed from your artwork,
my name will remain.
You do not have permission to alter
any artwork created by me. This
excludes any artwork where you have
supplied the graphics. This also
means you ARE not permitted to break
up the graphics to use on other
pages such as forums, mySpace and
so on without my written consent.
Copying any graphics is breaching
my copyright and you will be billed
for such use and also risk your
template being used in the future
for your breaches.
A checkout logo is a measly $7.99
and a store header is only $15.99;
a small price to pay rather than
having all your listings pulled
by eBay became you cut up the graphics
and created your own.
I also will contact your web host
if you have copied the template
images to their server and they
will remove these images as you
will be in breach of their terms
of use. Remember, I have full working
files as proof of ownership if you
state to them you created the artwork
yourself.
Please be warned that I have pursued
this matter many times in the past
when some users of my templates
have blatantly breached the terms
of use. They have had their listings
removed by eBay and this has caused
them major disruption having to
relist, plus the loss of sales with
the downtime. If you choose to breach
my license terms, you will be added
to my shame web page for doing so.
Single User License
Auction Templates
This is a license I give for you
to use my work for a 12 month period.
This covers the hosting cost of
your images within this period.
After 12 month's you will be required
to pay the standard pre-made template
fee [includes custom designed templates]
for another 12 months. This on average
is $24.99 - a small price to pay
for template image hosting.
This license means you do not have
permission to use on a second auction
site, under a different name (ID)
or on your own website, or even
resell. You can however, use on
as many pages under the ID as you
like. If you wish to use elsewhere,
all you do is purchase another license
and permission will be given.
My designs are not created in seconds
and especially for custom design,
I research first before your design
is created. The single user license
protects my intellectual property
and means I am not working for nothing.
Websites And Shopping Carts
Any designs, code, email forms
can be used only for the website
it was intended for. You do not
have permission to then alter the
code, images, forms and use on other
websites. This is in breach of my
license terms. Your name and website
will be added to my shame web page
here if you do this. Instead, please
purchase an additional license for
each website.
Unless you purchase the website
artwork outright with a royalty
free license, all copyrights belong
to Ideas Woman and this reference
ideaswoman.com must be visible on
all pages with a link back to Ideas
Woman.
Your eBay ID or Store Name
Please email me your eBay ID you
will be using the template for.
If the template is to be customised
with your ID, I will only customise
with the ID purchased under - no
exceptions.
Pre-made Designs
Making Changes To Original Order
With all pre-made designs, what
you see is what you get and any
alterations, change of colours,
fonts, layout or links will incur
fees to cover my time.
Please be aware that with instant
download templates, some are created
for auctions and some are created
for stores. All links relate to
ebay.com and you can easily change
to other eBay sites.
For templates that are not instant
downloaded, the turnaround time
is dependant on my workload as sometimes
many orders are received on the
same day and sometimes, no orders
for a few days. This makes it difficult
to predict.
Orders are usually completed within
7 workings days and I strive to
complete your order in the shortest
time possible; this is of course
is dependent on my workload.
Custom Design
Making Changes To Original
Order
Once you send me your images, logos
and content, please be aware that
you cannot then change your mind
or make alterations without incurring
additional fees, if I have already
commenced your order. Alterations
to your mock-layout will cause delays
in your receiving your final files
as well.
If you are wanting a detailed logo
created or specific graphics added
other than what I account for in
my fees for your design concept
creation, then you will be required
to make further payments to cover
the coasts of these.
I guarantee your unique custom
design will remain as such only
if the licenses are kept renewed
or you have purchased the artwork
outright. See Single User License
above.
Return Of The Design Brief
The design brief can be returned
at your convenience, however, if
90 days lapse, your order will become
a store credit as I can only guarantee
prices for 90 days. You can then
use your credit to purchase anything
from my catalog at my current prices.
Unlimited Free Support
Ideas Woman will provide unlimited
free support to you under these
conditions:
1. Website/shopping cart/auction
template images are hosted by ideaswoman.com
or by EZY4Uhosting
2. ideaswoman.com and a link back
to the Ideas Woman website remains
on the above pages
3. License fees have been paid [if
required]
If the above conditions have been
breached, then you will be charged
webmaster fees for any support provided.
Payments
Part of the condition of sale is
to make an instant payment. If you
are not able to pay, please contact
me before you purchase and I will
recommend payment alternatives.
I no longer accept direct deposits
via the bank as this is beyond my
control if the payment is lost and
then it seems I am still liable
to supply the goods, even though
I have not been paid. PayPal is
the only method of payment I accept.
IT COSTS YOU NOTHING TO USE PAYPAL
and you can easily transfer funds
to your PayPal account from your
own bank account or use your credit
card.
Customer Satisfaction Guarantee
As I strive for 100% satisfaction,
if the product (non-digital) is
not as advertised, you will be entitled
to a full-refund, less postage (if
paid).
If in the event of you making an
error with your order and a refund
is granted, a processing fee of
$9.95 plus PayPal costs incurred
applies to cover my time to arrange
the refund. Always read the listing
BEFORE you make your purchase to
ensure you are purchasing the correct
item.
If you are not happy with my custom
made digital products when the design
concept fee has been paid and the
design brief has been returned and
answered by you in full, then I
will ensure all work is completed
to your satisfaction.
I cannot give refunds for any digital
products once received via email
or that are instant download, nor
will I give refunds if you change
your mind.
I have the option to refuse a digital
purchase if I deem the purchase
is at threat of being misused or
exploited. In this event, you will
receive a full refund.
